The Learning Effect, LLC (“The Learning Effect,” “we,” “us,” or “our”) operates this online store and website, including all related information, content, features, tools, digital products, and services (the “Services”). Our Shopify storefront allows us to sell digital teaching resources directly to you.

We value your privacy. This Privacy Policy explains how we collect, use, share, and protect your personal information when you visit, access, or make a purchase from our Shopify store or otherwise communicate with us.

Your access to or use of the Services is conditional upon your acceptance of this Privacy Policy. If you do not agree with this Privacy Policy, please do not use or access the Services.


1. INFORMATION WE COLLECT AND STORE

We collect, receive, and store information you provide directly and information collected automatically when you interact with the Services. The categories of personal information we may collect include:

Identifying Information

  • Name
  • Email address
  • Billing address
  • (If requested at checkout for tax or fraud-prevention reasons) physical / mailing address
  • Phone number
  • IP address
  • Device identifier or online identifier
  • Social media user ID (if you interact with us via social or through embedded pixels)

Account Information

  • Username and password (if you create an account)
  • Preferences and saved items (e.g., wishlists, resources you’ve favorited)

Transaction / Commercial Information

  • Digital products you view, add to cart, download, purchase, or consider
  • Purchase history
  • Licenses associated with your purchase (e.g., single-teacher use)
  • Records of past orders and receipts

Payment Information

  • Credit or debit card number
  • Card expiration date
  • Card CVV/security code
  • Billing postal code
    Important: We do not store full payment card details ourselves. Payments are processed by third-party payment processors (for example, Shopify Payments, Stripe, PayPal). We receive confirmation that payment was completed, along with limited billing details, to prevent fraud, meet tax obligations, and provide customer support.

Internet / Activity Information

  • Browsing history on our storefront
  • Search history on our storefront
  • Clicks, pages viewed, time on page, referring URL, exit pages
  • Interactions with our emails and ads (including remarketing/retargeting pixels)
  • General location inferred from IP address (e.g., state or country)

Communications With Us

  • Support emails or messages you send to hello@thelearningeffect.com
  • Questions about access to downloads
  • Licensing and usage questions
  • Product feedback, reviews, or testimonials you voluntarily submit

We are not required by law or court order to collect most of this information; we collect it to operate our store, fulfill orders, protect our content, and improve our Services. We may combine information we collect from you across different interactions (for example, store purchase + email support conversation).

We do not knowingly request or store identifiable student data, and we ask that you do not send us personally identifiable student information when seeking support.


2. HOW WE COLLECT INFORMATION

We may collect personal information:

Directly from you

  • When you browse, create an account, make a purchase, download a resource, or contact us for support
  • When you sign up for email updates or marketing

Automatically when you use the Services

  • Through cookies, pixels, tags, log files, analytics tools, and similar technologies used on our site and checkout
  • Through Shopify, which hosts and powers our storefront

From service providers and partners

  • Payment processors (to confirm payment and prevent fraud)
  • Email service providers / marketing platforms (to send transactional and optional marketing emails)
  • Analytics and advertising platforms (for performance measurement, retargeting, etc.)

3. HOW WE USE YOUR INFORMATION

We may use personal information for the following purposes:

To provide and improve the Services

  • Process payments and deliver digital downloads
  • Send purchase confirmations, receipts, and access links
  • Help you retrieve purchases if you lose access and email us for help
  • Maintain and secure your account (if you create one)
  • Show you your order history

To personalize your experience

  • Remember what’s in your cart
  • Recommend related resources
  • Tailor offers and content based on grade level or topics you’ve browsed

To communicate with you

  • Respond to your questions about access, licensing, or product use
  • Send you service-related emails (for example, “Your download is ready”)
  • Send you marketing or promotional messages about new or related resources, sales, and classroom tips if you’ve opted in / not opted out

You can unsubscribe from marketing emails at any time using the “unsubscribe” link inside those emails. We may still send transactional messages about orders you’ve placed, account status, or policy changes.

To maintain security and prevent misuse

  • Detect and prevent fraud, suspicious activity, or violations of our license terms (for example, unauthorized file sharing)
  • Protect our intellectual property and the integrity of our business

To comply with law and enforce our rights

  • Maintain purchase records for tax and accounting
  • Respond to lawful requests from courts, regulators, or law enforcement
  • Enforce our Terms of Service and licensing terms

4. COOKIES, TRACKING TECHNOLOGIES & ANALYTICS

We (and Shopify, and certain service providers) use cookies, pixels, tags, and similar technologies to:

  • Keep items in your cart
  • Maintain session login state (if you create an account)
  • Analyze how visitors use our store and which resources are most viewed
  • Measure marketing and ad performance

Some cookies are essential to the core function of the store (for example, enabling checkout). Others are used for analytics and advertising.

You can manage cookies through your browser settings. Depending on your region, you may also see a cookie consent banner where you can adjust certain preferences. Disabling cookies may affect site functionality, including purchasing and download access.

Analytics
We use analytics tools (including Google Analytics and Shopify Analytics) to understand traffic, performance, and usage patterns. These tools may collect your IP address, device identifiers, online identifiers, pages visited, actions taken, and general location (for example, state/country).

You can opt out of Google Analytics by installing the browser add-on at https://tools.google.com/dlpage/gaoptout/. You can also adjust preferences in our cookie consent banner, where available.

Advertising & Remarketing
We may use tools such as the Meta Pixel and similar ad platforms to measure the effectiveness of our marketing and to show more relevant ads based on your activity with our store (for example, showing you a bundle that matches products you viewed). The information collected through these tools may allow those platforms to recognize you across different websites or devices.

Some of this activity may be considered “targeted advertising,” “cross-context behavioral advertising,” or “sharing” under certain privacy laws. In locations where this applies, you may have the right to opt out. See Section 8 (“Your Rights and Choices”) for more information.


5. HOW WE SHARE / DISCLOSE YOUR INFORMATION

We do not sell your personal information for money.

We may disclose personal information in these situations:

With Shopify
Our store is hosted by Shopify. Shopify collects and processes personal information to operate the storefront, handle checkout, detect fraud, and provide analytics and reporting. Shopify may also use your information to improve its services across all Shopify-powered stores. In some cases, Shopify independently determines how and why to process your data. For more information about Shopify’s privacy practices or to exercise rights related to Shopify’s use of your data, please see the Shopify Consumer Privacy Policy and Shopify Privacy Portal.

With payment processors
When you make a purchase, your payment card details are provided directly to our payment processor(s), such as Shopify Payments, PayPal, or Stripe. We receive confirmation of payment, but we do not store your full card number.

With service providers
We may share information with vendors who assist us with:

  • Email delivery and email marketing
  • Secure file delivery / download access
  • Data storage and hosting
  • Analytics, site performance, and security
  • Customer support

These service providers may only use your information to perform services on our behalf.

With marketing and advertising partners (if applicable)
We may share limited information with advertising/remarketing partners so that we can show you relevant ads or measure campaign performance. Those partners use the information in line with their own privacy notices and applicable law. In some regions, you may have the right to opt out of these uses.

For legal, safety, and enforcement reasons
We may disclose information if we believe it is necessary to:

  • Comply with legal obligations or valid legal process
  • Respond to law enforcement or government requests
  • Protect the rights, property, or safety of The Learning Effect, our customers, or others
  • Enforce our Terms of Service and licensing terms
  • Detect, prevent, or address fraud, security, or technical issues

Business transfers
If we are involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar event, your information may be transferred as part of that transaction.


6. CHILDREN’S PRIVACY

Our Services are designed for adult educators. We do not knowingly collect personal information from children under the age of majority in their jurisdiction and we do not market to children.

If you are a parent or guardian and believe a child has provided personal information to us, please contact hello@thelearningeffect.com. We will take reasonable steps to delete that information.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we “sell” or “share” (as defined by applicable law) the personal information of individuals under 16 years of age.

Please do not send us identifiable student information (student names, grades, IEP data, etc.) in support emails or uploads.


7. SECURITY

We take reasonable and appropriate steps to protect personal information, including:

  • Using SSL encryption or similar security technologies during checkout and account login
  • Maintaining up-to-date software and security safeguards
  • Limiting access to personal information to what is necessary
  • Deleting or de-identifying personal information when it is no longer needed for legal, tax, or business purposes

However, no method of transmission over the internet or method of electronic storage is 100% secure. We cannot guarantee absolute security. Please do not send highly sensitive information (like full credit card numbers) to us via unencrypted email.


8. YOUR RIGHTS AND CHOICES

Depending on where you live, you may have some or all of the rights listed below. These rights are not absolute and may apply only in certain circumstances. We may also deny a request if an exception applies under the law.

Possible rights include:

  • Right to Access / Know: Request access to the personal information we hold about you.
  • Right to Portability: Request a copy of certain personal information in a portable format.
  • Right to Correct: Request that we correct inaccurate personal information.
  • Right to Delete: Request that we delete certain personal information we maintain about you.
  • Right to Restrict / Withdraw Consent: Request that we limit or stop certain processing, where applicable.
  • Right to Opt Out of Targeted Advertising / Sharing / Sale: Opt out of certain uses of personal information for targeted advertising or “sharing” between businesses for cross-context behavioral ads, where those activities apply. We will also honor Global Privacy Control signals where required.
  • Right to Opt Out of Direct Marketing: Opt out of our marketing emails at any time by clicking “unsubscribe.”
  • Right to Lodge a Complaint: File a complaint with a data protection authority in your jurisdiction.
  • Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

We may need to verify your identity to protect your information. Typical verification may include your name, email address, and IP address or recent order details. If you authorize someone else to submit a request for you, we may ask them to provide proof of that authorization and may still ask you to confirm directly.

If your request relates to Shopify’s independent use of your personal information (see Section 9), please refer to Shopify’s Consumer Privacy Policy and Shopify’s Privacy Portal for instructions on exercising those specific rights.

If you have a complaint about how we handle your personal information, you can contact us directly using the information above. Depending on where you live (for example, Canada, certain U.S. states, the UK, EU, or Australia), you may also have the right to escalate your complaint to your local privacy or data protection authority if you are not satisfied with our response.


9. RELATIONSHIP WITH SHOPIFY

Our store is hosted by Shopify. Shopify collects and processes personal information about your interactions with our storefront and checkout (for example, to run our store securely, prevent fraud, improve performance, and offer features like personalized recommendations across Shopify-powered stores).

In some cases, Shopify is acting on our behalf. In other cases, Shopify may act independently and determine how and why to process your personal information.

10. INTERNATIONAL TRANSFERS

We are based in the United States, and our service providers (including Shopify) may process your personal information in the United States and other countries that may have different data protection laws than your home jurisdiction.

If you are located in a region that restricts data transfers (for example, the European Economic Area, United Kingdom, certain Canadian provinces, or Australia), we and/or Shopify may rely on recognized transfer mechanisms such as Standard Contractual Clauses or adequacy decisions, where applicable.


11. DATA RETENTION

We keep personal information only as long as needed for the reasons it was collected, including:

  • Providing access to your purchased digital downloads
  • Maintaining business records for tax, accounting, and legal compliance
  • Preventing fraud or abuse
  • Enforcing our Terms of Service and license terms
  • Resolving disputes or providing customer support

When personal information is no longer needed, we will delete it or de-identify it within a reasonable timeframe, subject to legal retention requirements.


12. DO NOT TRACK / GLOBAL PRIVACY CONTROL

“Do Not Track” (DNT) is a browser setting that requests that websites not track you. Many websites and online services do not currently respond to DNT signals.

Where legally required (for example, certain U.S. states), we will treat a Global Privacy Control (GPC) signal as a request to opt out of certain types of data “sharing” or targeted advertising for that browser/device. Other than honoring GPC where required, we do not guarantee that we respond to all other browser-based DNT signals.


13. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes in our business, our practices, our use of Shopify or other providers, or applicable law. When we make changes, we will update the “Last updated” date at the top of this page. If required by law, we will also provide additional notice.

Your continued use of the Services after we post an updated Privacy Policy means you accept the changes.
